Physicians as Employees: Critical Legal Issues in the New Medical Workplace: The Individual Employed Physician

This forum focuses on key issues arising in an employed physician’s workplace (whether hospital, medical college, practice group, independent physician association, or professional staffing organization). Issues to be discussed include: the competing and shared interests of medical employers and physicians; the fundamental tension between physician autonomy and duty of loyalty; the impact of the employment relationship on patient welfare and quality care; and traditional employment law issues, e.g., the employment contract, compensation, benefits, insurance coverage; duties and responsibilities, restrictive covenants, peer review/corrective action, and the interplay of individual agreements, hospital/practice group by-laws, managed care agreements, and external laws and regulations.
